Lawful Development Certificate for Green Belt driveway and access

Tyler-Parkes has successfully secured a Lawful Development Certificate from Warwick District Council for an access and associated driveway of approximately 120m in length across a field in the Green Belt at Chessetts Wood. Following a decisive appeal decision, we were able to demonstrate that the access and driveway would be Permitted Development under the regulations, so could be undertaken without the need for planning permission and was therefore lawful.

The securing of the Certificate followed a lengthy planning process, where we obtained permission for the removal of a holiday-let occupancy restriction to allow their occupancy as open market housing following a successful appeal on a number of dwellings. This decision was then followed by the use of permitted development rights to secure an alternative means of access to the dwellings. Our involvement rendered the dwellings separately marketable, served by a wholly separate and lawful new access.
